These Terms of Service (the "Terms") govern your access to and use of the DXVPNservice (the "Service") operated by DXVPN(the "Operator").
By creating an account and ticking the consent checkbox during registration, you accept these Terms in full. If you do not agree, do not use the Service.
The Operator provides access to the service, which includes:
Services are provided on a subscription basis according to the plans published at dxvpn.sechb.com.
To create an account you must be at least 16 years old, the minimum age under the General Data Protection Regulation (GDPR) and applicable member-state thresholds.
To purchase a subscription you must be at least 18 years old or have reached the age of contractual capacity in your jurisdiction, whichever is higher.
By registering, you confirm that you meet the applicable age requirement. Accounts found to belong to users who do not meet the threshold will be suspended pending verification.
You are entitled to use the Service for any lawful purpose, including personal privacy, commercial use within your subscription plan limits, and device management up to the peer limit of your plan.
The following uses are strictly prohibited. Engaging in any prohibited activity may result in immediate account termination and, where required by law, notification to relevant authorities.

Abuse reports should be sent to not yet configured.
The Operator will investigate reports within a reasonable timeframe. Upon confirming a violation, the Operator reserves the right to: (a) issue a warning; (b) temporarily suspend the account; (c) permanently terminate the account; or (d) take legal action. The severity of the response will be proportionate to the nature and severity of the violation.
No refund is issued for accounts terminated due to violations of the Acceptable Use Policy.
The Operator reserves the right to modify, suspend, or discontinue the Service (or any feature thereof) with reasonable notice, except where the modification is required urgently for security or legal compliance reasons.
The Operator will use commercially reasonable efforts to maintain 99.5% monthly uptime. Planned maintenance will be communicated in advance where possible. Downtime caused by events beyond the Operator's reasonable control (see Section 10) does not count against the uptime commitment.
The Operator will not monitor the content of your encrypted VPN traffic.
Subscription fees are charged in advance for the selected billing period (monthly, quarterly, or annual). All prices are displayed inclusive of applicable taxes where required.
Payment is processed by third-party payment providers. The Operator does not store payment card details. By subscribing you authorise the selected payment provider to charge the fee on a recurring basis until cancelled.
If a payment fails, the Operator will attempt to re-charge and notify you by email. After a 7-day grace period of non-payment, the subscription will be suspended. After a further 30 days of suspension, it may be cancelled and peer configurations deleted.
The Operator reserves the right to adjust pricing with at least 30 days' notice to active subscribers. If you do not accept the new pricing, you may cancel before the new price takes effect.
If you are a consumer in the European Economic Area, you have the right to withdraw from this contract within 14 calendar daysof the date you purchased a subscription ("cooling-off period"), without giving any reason.
By explicitly requesting that the Service be activated immediately upon purchase and acknowledging that you lose your right of withdrawal once the Service is fully performed, you waive this right from the moment the Service is activated and you begin using it.
If you did not tick the "start immediately" box during checkout and the Service has not yet been activated, you may withdraw within the 14-day period by notifying the Operator of your decision.
To the maximum extent permitted by applicable law, the Operator shall not be liable for: (a) loss of profits, revenue, data, or business opportunities; (b) indirect, incidental, special, consequential, or punitive damages; or (c) any damages arising from your inability to access the Service due to government actions, ISP blocks, or force majeure events.
Subject to applicable consumer protection law, the Operator's total aggregate liability for any claim under these Terms shall not exceed the amount paid by you for the Service in the three (3) months immediately preceding the event giving rise to the claim.
The Operator shall not be liable for any delay or failure to perform resulting from causes outside its reasonable control, including but not limited to acts of government, sanctions, ISP-level blocking, natural disasters, cyberattacks on infrastructure, or failures of upstream providers.
In the event of a force majeure lasting more than 30 consecutive days, either party may terminate the contract by written notice. In such case the Operator will refund the unused portion of any prepaid subscription on a pro-rata basis.
The Operator is not responsible for the content of websites or services you access through the VPN tunnel. The Operator does not endorse, sponsor, or accept responsibility for any third-party content.
The Operator processes personal data in accordance with the Privacy Policy available at dxvpn.sechb.com/privacy. By accepting these Terms you acknowledge that you have read and understood the Privacy Policy.
The Service, including its software, documentation, trademarks, and branding, is owned by or licensed to the Operator. You are granted a limited, non-exclusive, non-transferable licence to use the Service for personal or commercial purposes within the scope of your subscription plan.
You may not reverse-engineer, decompile, or disassemble any part of the Service except to the extent permitted by mandatory applicable law.
These Terms are governed by the law of the jurisdiction in which the Operator is established. Any dispute arising under these Terms that cannot be resolved amicably shall be submitted to the competent courts of that jurisdiction.
If you are a consumer in the EU, you also have the right to use the European Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
The Operator reserves the right to amend these Terms at any time. Material changes will be notified to active subscribers by email at least 14 days before taking effect. Continued use of the Service after the effective date constitutes acceptance of the amended Terms. If you do not agree, you may cancel before the new Terms take effect.
